(Reuters) - Trade officials will announce a major trade enforcement action against China on Tuesday, according to a Trade Representative's office advisory obtained from a business group.

The advisory, which was distributed to media on a not-for-publication basis, said Trade Representative Ron Kirk "will hold a press conference to announce a major trade enforcement action against China."

The release did not provide any additional details.

The US is bringing a case against China in the World Trade Organisation to challenge the Asian nation’s imposition of trade remedies against American poultry exports, a move that could heighten economic tensions between the two countries.
The move was announced on Tuesday by the Obama administration, which charged that since China set the antidumping and countervailing duties against US chicken parts last September, American exports of those products had tumbled by 90 per cent, adversely affecting 300,000 producers and workers in the supply chain.

US officials said China was unfairly making use of these trade remedies to retaliate against other actions taken by the US on the trade enforcement front. In the case of poultry, this was occurring in violation of global trade rules that China agreed to when it joined the WTO a decade ago.

“Let me be clear: the US does not arbitrarily seek disagreements with China,” said Ron Kirk, US trade representative, as he unveiled the grounds for the US action. “But we won’t negotiate indefinitely, because US farmers, ranchers, small business owners and workers can’t afford to wait when their exports are being blocked and American jobs are at stake.”

Tuesday’s announcement marks only the first step in the WTO process in that the US is requesting consultations with China in order to resolve the dispute. But if no agreement is reached over the next two months, the US can demand that the world trade body set up a special settlement panel to consider the claim.

The US and China have been at loggerheads for several years over different aspects of economic and trade policy, including the level of China’s currency, which the US believes should be allowed to appreciate. The US has taken action against China at the WTO on a number of fronts since President Barack Obama took office, on matters ranging from electronic payment systems to raw materials, tyres and steel.

“Today, we continue to believe that two-way trade with China works for the American people when we insist that China lives up to its commitments, plays by the rules to which it has agreed, and maintains a level playing field for American producers to compete,” Mr Kirk said.

Tensions between the US and China over American chicken exports escalated last September when China imposed antidumping duties on those products ranging from 50.3 per cent to 105.4 per cent, and countervailing duties ranging from 4 per cent to 30.3 per cent. In announcing the complaint, US officials said China appeared to have “failed to observe numerous transparency and due process requirements, failed to properly explain the basis for its findings and conclusions, incorrectly calculated dumping margins, incorrectly calculated subsidy rates and made unsupported findings of injury to China’s domestic industry.”

A spokesperson for the Chinese government in Geneva, where the WTO is based, could not be immediately reached for comment.

The move by the US on poultry comes as officials are considering their next steps in order to put pressure on China to ease restrictions on the export of rare earths, another simmering trade disagreement.
Domestically, the US appears on the verge of ratifying long-stalled free-trade agreements with South Korea, Panama and Colombia, but Republicans and Democrats in Congress are continuing to squabble over the details.

据海外媒体报道,让·科克说,“如果我们认为中国违反了做为世贸成员的承诺,因而危及到美国人的就业,我们是不会袖手旁观的。”

美国一位贸易官员说,中国的关税从50%到100%不等,大大增加了中国进口商为进口美国家禽支付的价钱。

中国在2010年9月对美国家禽施加了关税。北京说,美国生产商获得政府补贴,以低于市场价向中国出口产品。

但是美国官员说,中国采取这个举措时没有按适当程序。

中国和俄国是美国家禽出口的两大市场。2009年,美国向中国出口家禽价值6.47亿美元。

美国贸易官员说,自中国施加关税以来,美国向中国的出口减少了90%。

世贸规则要求发生贸易摩擦的成员国之间先通过协商解决分歧。

如果协商失败,美国可以要求世贸设立一个小组,听取美国的陈述。
